Charges of wrongful termination, sexual harassment, discrimination, invasion of privacy, false imprisonment, breach of contract, emotional distress, and wage and hour law violations are a growing concern of business owners today. Insurance coverage is available to defend and pay judgments on these charges. This coverage usually requires a separate policy. Even if the employer is not guilty of the charges, defense costs average more than $40,000.
Employment Practices Liability (EPL) protects business owners against employee suits for rights protected under laws and protections brought under the following Acts:

Title VII of the Civil Rights Act of 1964

ADA (Americans with Disabilities Act) of 1990

Civil Rights Act of 1991

ADEA (Age Discrimination in Employment Act) of 1967

Family and Medical Leave Act (FMLA)

The Equal Opportunity Employment Commission (EEOC) interprets and enforces these laws. More recently, with the expansion of privacy law(s), employee privacy concerns have heightened as private employee data is stored electronically. This is not always covered under an EPL policy, but there are cyber liability and network security policies for protection.

Directors and Officers Liability Insurance (often called D&O) is liability insurance payable to the directors and officers of a company, or to the organization(s) itself, to cover damages or defense costs in the event they suffer such losses as a result of a lawsuit for alleged wrongful acts while acting in their capacity as directors and officers for the organization.
Coverage can extend to defense costs arising out of criminal and regulatory investigations/trials as well; in fact, civil and criminal actions are often brought against directors/officers simultaneously. D&O has become closely associated with broader management liability insurance, which covers liabilities of the corporation as well as the personal liabilities for the directors and officers of the corporation.

What is covered? Common items covered by an inland marine policy include:

Computers & computer systems

Tools and equipment for artisan contractors – from mobile equipment to hand tools

Fine Art Dealers & Galleries – covers fine art and tools & equipment used in conjunction with fine art

Camera equipment – photographers

Motor Truck Cargo – covers the goods being carried by an insured trucker

Transportation Form – covers goods shipped by or to an insured via common carrier

Pet Groomers – covers their equipment, especially for those with mobile operations

Veterinarians – covers their equipment, especially when portable in nature

Vending Machine Form – used to cover vending machines (does not include contents)

Dealers Service Form – covers equipment used by servicing contractors / installers such as appliances, flooring, plumbers, etc.

Business contents, equipment and tools that move from location to location need this coverage. Remember that most contents coverage is location-specific, so you should discuss coverage with your agent for anything that goes off your business premises.

Virginia law requires businesses with three or more employees, including owners, to carry workers compensation coverage on the employees. Employers’ liability exposure is reduced when Workers Compensation is provided. This coverage pays medical expenses and partial wage continuation when an employee is injured on the job.
Even though you take every precaution to keep your employees safe while working for you, accidents still happen. One injury can prevent a person from working for a significant period of time, leading to financial hardship. And it’s important to note that “fault” doesn’t matter when it comes to a workplace injury, so it is highly likely that you will be responsible when an employee is injured on the job.
Fortunately there is a way to protect your business from a lawsuit and your employees from loss of income.
Part I. Workers Compensation
This section of a Workers Compensation policy covers bodily injury by accident that occurs on the job and by disease caused or aggravated by the conditions of employment.
For example: A worker falls and is injured due to a spill on the floor. Benefits available under workers compensation are medical treatment, permanent and temporary disability and death benefits.
Part II. Employers Liability
This section of the policy protects employers if they are found civilly liable for employee injuries that arise out of and in the course of employment. Employers’ liability coverage helps protect your business against care and loss of services, certain types of third-party claims and consequential bodily injury to a family member of the employee

Vehicles titled in a business name and/or used in a business capacity usually require a commercial auto policy. Don’t try to insure your business vehicle on a family or personal auto policy. If an accident occurs, coverage may be denied if it is determined the vehicle is used for business. Whether you use your own car or own a fleet of trucks, having the right protection in place is imperative. There is important coverage you need – including liability, personal injury/medical coverage, comprehensive and collision coverage.

Commercial general liability insurance protects your business from third party claims for bodily injury, associated medical costs and damage to someone else’s property.
General liability insurance is critical if you or your employees:
Visit a client’s place of work
Have access to a client’s equipment
Write or speak about a client’s business
Use third-party locations for any business related activities
Often, commercial general liability insurance is required before entering into a contract.
Commercial general liability coverage protects and defends you against claims of bodily injury or property damage triggered by their negligence. A business may sue you – and whether it’s your fault or not – a commercial general liability policy will protect your business against covered claims by paying defense costs and any damages up to your policy limit.
